The State of California is a “no fault” state and parties may divorce for any reason. Irremediable break down of the marriage is the only requirement. You must be a resident of the County for 3 months and the State of California for 6 months to meet the residency requirement to file your divorce in California. A Court in California can not make you unmarried or restore your status to one of a “single” person until 6 months and 1 day from the date of the service of the Petition on the other party. Legal Separation

The Court treats a legal separation exactly as a divorce when issuing orders, except the Court does NOT make you unmarried. In an action for legal separation the Court will equally divide the community estate and make orders for child support and spousal support and child custody and visitation. However the difference between a divorce and a legal separation is that the Court will NOT restore you to a “single” person status you will continued to be “legally” married and may NOT remarry until the Court restores your status as a “single” person.
